Terms and Conditions

General:

  1. All goods and services are subject to HST.
  2. Prices are subject to change without notice.
  3. Pallets/Skids are to be returned in person; accompanied by an original invoice in order to obtain a refund.
  4. All calculations on materials is customer responsibility.
  5. A 25% re-stocking charge will be applied on returnable items. Returned items must be in an original/acceptable condition (original packaging, clean and undamaged).
  6. No returns on concrete materials, natural stone and Garden Bags.
  7. No refunds on fulfilled services – such as shipping, split charges or cuts.
  8. Split charges will be applied to orders that require customization to the original package.
  9. Damaged, defective, shortages of materials and or any discrepancy related to an order must be reported to Toemar within 24 hours upon receiving. If no claim is made within this time frame – the order delivered or picked up will be considered correct.
  10. Any refund/cancellation on invoices paid with credit or debit will be subject to a 5% cancellation – unless performed (purchase and void) within the same business day.
  11. No guarantee is given on exact blends, mixes, surface texture on concrete or natural stone materials. This is due to variations in colour pigment (dye lot), effects of moisture, effects of temperature and efflorescence (whitish salt residue). Please verify guarantees and warrantees from the concrete manufacturer; this can be obtained with a product catalog and or website.
  12. Toemar Landscape & Garden Supplies is NOT responsible for property damage if given permission to enter private property and or given permission to load a vehicle (either by hand or equipment).
  13. Terms of payment are in advance unless otherwise arranged. Account terms are subject to credit approval. Terms are Net 30, 2% interest per month on late payments (24% per annum) – interest to be charged stating on the first day of the following month. Overdue accounts may be subject to legal and administrative charges.
  14. In the case of default of the Purchaser, Toemar Landscape and Garden Supplies may at the time, without notice, enter upon the premises where goods are located, take possession of, and remove them.

Services:

  1. Delivery of Skidded/Palletized/Garden Bag materials will be conducted with a forklift. Materials are to be placed at the curbside of the delivery address as default. Special instructions must be communicated during the ordering process prior or prior to delivery date. Specials instructions that include placement on unpaved areas will be at the driver’s discretion and will not be guaranteed. Toemar Landscape & Garden Supplies is NOT responsible for property damage if given permission to enter private property.
  2. All Skidded/Palletized/Garden Bag deliveries have time limit of 30 minutes upon arrival at the delivery address. If the delivery service exceeds 30 minutes than extra charges will apply, consult staff for more details.
  3. Delivery of Bulk Materials will be conducted on the driveway of the delivery address as default. Special instructions must be communicated during the ordering process or prior to the delivery date. Specials instructions that include placement on unpaved areas will be at the driver’s discretion and will not be guaranteed. Toemar Landscape & Garden Supplies is NOT responsible for property damage if given permission to enter private property.
  4. Delivery of Disposal Bins are placed on the driveway of the delivery address as default. Special instructions must be communicated during the ordering process or prior to the delivery date. Toemar Landscape & Garden Supplies is NOT responsible for property damage if given permission to enter private property.
  5. Disposal Bins containing Soil, Concrete or Asphalt will automatically be picked up after 4 business days. Disposal Bins containing Renovation Waste are automatically picked up after 7 business days. Early pick up needs to be communicated via phone, email or in-person. Late charges do apply if Disposal Bin is not ready for pick up, consult with staff for more details. Toemar Landscape & Garden Supplies is NOT responsible for property damage if given permission to enter private property.
  6. Disposal Bins containing Soil, Concrete or Asphalt are not be mixed. Mixed loads will be automatically rejected and will either be dumped out on the delivery addresses driveway and or subject to extra charges; consult staff for more details.
  7. The only method of payment for ALL Bin Disposal Rentals is with a Credit Card. During the ordering process, a Credit Card will be collected for payment and security purposes.
  8. Disposal Bins containing Renovation Waste will be charged for the following; the bin (a flat rate) plus a min charge of weight (2 Metric Tons). Weight exceeding 2 Metric Tons will be subject to extra charges – at the same rate per MT as the order originally indicated.
  9. The only method of payment for ALL Tool and Equipment Rentals is with a Credit Card. During the ordering process, a Credit Card will be collected for payment and security purposes.
  10. All Tool and Equipment Rentals are to be returned in clean and good condition. Damage and or cleaning of these items will be subject to extra charges.
  11. Gas powered rental equipment must be returned with the same quantity of fuel as when originally rented. A fuel charge will apply if this condition is not met.
  12. If a Tool and Equipment Rental exceeds the agreed rental time, late fees will apply. The price per day charge of the given rental will be made to the client until the Rental has been returned.
